Surrogacy 101 – three things you may not know about surrogacy in Hong Kong

  1. All commercial surrogacy are prohibited in Hong Kong, regardless of whether they are undertaken in Hong Kong or anywhere in the world. This is also regardless of whether it is legal in the jurisdiction where the surrogacy took place.  

  2. Only a married heterosexual couple can engage in surrogacy arrangements.

  3. Even if a child is biologically linked to the couple who commissioned the surrogacy, they are not deemed the legal parents until a Parental Order is obtained in Hong Kong.    

Surrogacy in Hong Kong is a complicated matter and legal advice should be obtained prior to engaging in such an arrangement.
